It was reported today that Viacom admits error in ordering Youtube to take down a piece of video clip uploaded at the video sharing site.
Viacom initially denied sending the Digital Millennium Copyright Act (DMCA) takedown notice that resulted in the removal of the video from YouTube, while saying it had no objection to “Stop the Falsiness.” However, Viacom later conceded it was the source of the demand and admitted error in taking action against the parody.
The said piece of video is posted below:
Viacom admission of their error leads them to learn to take steps to protect the free speech rights of those who post videos to YouTube and similar video sharing sites. But the lessons are not just for Viacom.
All of Us
Everyone of us should also learn the lesson to protect the copyright of all the videos made available on the internet. Well, that’s the main reason why I stopped uploading Naruto Anime videos at Youtube, because what I did with Naruto Anime Episode videos was illegal. However, this report also tells us that we can actually use copyrighted videos just like what the author of the controversial video above did. Consider Utube’s idea:
To me, the biggest part of the settlement is Viacom’s general acceptance of users’ transformative, noncommercial uses of its copyrighted works.
Copyright Owners
Copyright owners should learn too that not all use of copyrighted content without your permission are unacceptable, as pointed by SplashCast.
As for Youtube, or for Google who owns the Youtube, Donna has this message:
Google has a responsibility to protect the legitimate content ownership rights of the media companies upon which YouTubers rely for their high quality clip culture entertainment.
Google ought to choose to respect copyright by proactively blocking unauthorized uploads of copyright videos. Wouldn’t it be the simplest solution for all?
